1. Introduction
This website, www.eclipseclouds.com (Site), is operated by Eclipse Clouds (Eclipse Clouds, we, us or our).
These Terms and Conditions (Terms) apply to your use of the Site and to purchases made through the Site.
By using the Site or placing an order with us, you agree to these Terms.
2. Eligibility and Use of the Site
You must be at least 18 years old, or otherwise have the legal capacity to enter into a binding agreement, to place an order through the Site.
You must not use the Site:
- for any unlawful or fraudulent purpose;
- in a way that infringes another person's rights;
- to transmit malicious software, viruses or harmful code;
- to interfere with the operation or security of the Site;
- to collect or scrape information from the Site using automated means without our permission;
- to send unsolicited communications; or
- in any way that could damage Eclipse Clouds, the Site or another user.
3. Products and Product Information
We make reasonable efforts to ensure that product descriptions, photographs, specifications, prices and other information displayed on the Site are accurate.
Colours, appearance and proportions may vary slightly depending on lighting, photography and your device or screen.
We may update product information, pricing, availability and specifications from time to time.
If we discover a material error affecting a product you have ordered, we will contact you as soon as reasonably practicable and, where appropriate, give you the opportunity to proceed with the corrected information or cancel the affected order.
Nothing in this section limits your rights under the Australian Consumer Law.
4. Orders
When you submit an order through the Site, you are offering to purchase the selected products at the price and on the terms displayed at checkout.
An order is not necessarily accepted merely because payment has been submitted or authorised.
We may decline or cancel an order where reasonably necessary, including where:
- a product is unavailable;
- payment cannot be processed or verified;
- an incorrect price or product information was displayed;
- we reasonably suspect fraud or unauthorised activity;
- a delivery address cannot reasonably be serviced; or
- circumstances outside our reasonable control prevent us from fulfilling the order.
If we cancel an order after payment has been received, we will refund the amount paid for the cancelled portion of the order.
5. Order Changes and Cancellations
If you need to change or cancel an order, contact info@eclipseclouds.com as soon as possible.
We will make reasonable efforts to accommodate changes or cancellations before the order has been processed or dispatched, but we cannot guarantee that a change or cancellation can be made once fulfilment has begun.
If your order has already been dispatched, our Returns and Refunds Policy will apply.
Nothing in this section affects any rights you may have under the Australian Consumer Law.
6. Prices and Payment
Unless otherwise stated, prices displayed on the Site are in Australian dollars (AUD).
Any applicable shipping charges, taxes or other charges payable through the Site will be displayed at checkout where applicable.
You must pay the total amount shown at checkout using one of the payment methods made available on the Site.
You represent that you are authorised to use the payment method provided.
We may use third-party payment providers to process transactions. Your use of a third-party payment service may also be subject to that provider's terms and privacy practices.
7. Discounts and Promotions
From time to time, Eclipse Clouds may offer promotions, discounts, coupon codes, bundle discounts or other special offers.
Additional terms may apply to a promotion and will be displayed with the relevant offer where applicable.
Unless otherwise stated, promotional offers:
- cannot be redeemed for cash;
- apply only during the stated promotional period;
- may be subject to product or quantity restrictions; and
- may be changed or withdrawn for future orders at our discretion.
Any changes will not retrospectively alter an order that has already been accepted by us.
8. Shipping and Delivery
Shipping options, destinations, charges and estimated delivery timeframes are described in our Shipping Policy and displayed at checkout where applicable.
Eclipse Clouds currently offers free standard shipping within Australia and may offer shipping to selected international destinations.
Delivery estimates are not guaranteed delivery dates.
Actual delivery times can be affected by carrier delays, fulfilment processing, public holidays, remote locations, customs, weather and other circumstances outside our reasonable control.
You are responsible for providing complete and accurate delivery information.
Risk in the products passes to you when the products are delivered to the delivery address supplied with your order, subject to any rights available to you under applicable law.
9. Returns, Refunds and Australian Consumer Law
Our voluntary returns arrangements are described in our Returns and Refunds Policy.
Our 30-day change-of-mind returns policy is provided in addition to, and does not replace or restrict, your rights under the Australian Consumer Law.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.
10. Product Use and Health Information
Information provided on the Site, in advertisements, on packaging or in other Eclipse Clouds materials is provided for general product information purposes.
Unless expressly stated otherwise, Eclipse Clouds products are not medical devices and information provided by Eclipse Clouds is not intended to constitute medical advice, diagnosis or treatment.
You are responsible for determining whether a product is appropriate for your individual circumstances and for using products in accordance with their intended purpose and any instructions provided.
If you have a medical condition or have concerns about whether a product is suitable for you, you should seek appropriate professional advice.
Nothing in this section limits any rights or remedies available under applicable law.
11. Intellectual Property
Unless otherwise indicated, the Site and its content — including text, graphics, product photographs, branding, logos, videos, designs, layouts and other materials — are owned by or licensed to Eclipse Clouds and are protected by applicable intellectual property laws.
You may access and use the Site for personal and non-commercial purposes.
Unless permitted by law or authorised by us in writing, you must not:
- reproduce or commercially exploit our content;
- modify or create derivative works from our content;
- remove intellectual property notices;
- use Eclipse Clouds branding in a way that suggests an affiliation, endorsement or relationship that does not exist; or
- use our content for commercial advertising or resale.
Nothing in these Terms prevents you from sharing links to publicly available pages or sharing Eclipse Clouds content through ordinary social media functionality, provided you do not misrepresent your relationship with us or infringe our rights.
12. Reviews, Feedback and User Content
If you submit a review, photograph, comment, testimonial or other content to Eclipse Clouds, you confirm that:
- the content is based on your genuine experience where represented as such;
- you have the right to provide the content;
- it does not unlawfully infringe another person's rights; and
- it is not knowingly false, defamatory or misleading.
Where you give us permission to publish user content, you grant Eclipse Clouds a non-exclusive licence to reproduce, display and use that content for the purposes communicated to you, subject to applicable law.
We will not knowingly alter a genuine customer review in a way that materially misrepresents the customer's opinion.
13. Third-Party Services and Links
The Site may contain links to or integrations with services operated by third parties, including payment, shipping, analytics, review and social media services.
Unless otherwise stated, we do not control third-party websites and are not responsible for their independent content, availability, security or privacy practices.
Your dealings with a third party may also be governed by that third party's terms.

Nothing in these Terms excludes, restricts or modifies any liability, right or remedy that cannot lawfully be excluded, restricted or modified, including rights under the Australian Consumer Law.
To the maximum extent permitted by law, Eclipse Clouds is not responsible for loss or damage to the extent that it is caused by:
- your misuse of a product;
- your failure to follow instructions or warnings;
- unauthorised modification of a product;
- information or actions of an unrelated third party; or
- circumstances for which we are not legally responsible.
Nothing in these Terms excludes liability for reasonably foreseeable loss or damage where the law requires Eclipse Clouds to compensate you.
16. Events Outside Our Reasonable Control
We will not be responsible for delay or failure to perform an obligation to the extent that the delay or failure is caused by circumstances outside our reasonable control.
These circumstances may include natural disasters, severe weather, carrier disruptions, industrial action, government action, infrastructure failures, supply-chain disruptions or similar events.
Where such an event affects an order, we will take reasonable steps to minimise the impact and communicate with you where appropriate.
Your statutory rights remain unaffected.
17. Feedback, Complaints and Disputes
If you have a concern or complaint relating to an order, product or your experience with Eclipse Clouds, please contact us first so that we have an opportunity to resolve the issue.
We will make reasonable efforts to respond and resolve complaints fairly.
Nothing in this section prevents either party from exercising a legal right, contacting an appropriate consumer protection body, or commencing proceedings where entitled to do so.
18. Changes to These Terms
We may update these Terms from time to time to reflect changes to our business, Site, products or applicable requirements.
Updated Terms will be published on the Site with a revised "Last updated" date.
The Terms applying to an order will generally be those in effect when that order was placed, unless a change is required by law or is expressly agreed between us and you.
19. Severability
If any part of these Terms is found to be invalid, unlawful or unenforceable, that part will be interpreted or removed to the minimum extent necessary and the remaining provisions will continue to apply.
20. Governing Law
These Terms are governed by the laws of Western Australia, Australia.
Subject to any rights you may have to bring a claim elsewhere under applicable consumer law, the parties submit to the jurisdiction of the courts of Western Australia and applicable Commonwealth courts.
